West Haven family appears in court for death of 12-year-old, community holds vigil



WEST HAVEN, Utah (ABC4) — Two weeks after Gavin Peterson died on July 9, his stepmother and older brother appeared virtually in court for the first time just hours ahead of a community candlelight vigil in memory of the 12-year-old boy.

On July 18, the Weber County Sheriff’s Department arrested Gavin Peterson’s father, stepmother, and older brother for alleged aggravated child abuse and child abuse homicide. After the arrests, the Weber School District released a statement saying employees had filed several reports warning the Utah Division of Child and Family Services of possible abuse.

“How did it happen right under our noses and us not know?” said Jackie Allred, a neighbor and vigil organizer. “I have more empathy and sympathy for a mouse than this woman did her child.”

On Tuesday, July 23, Gavin’s stepmother and brother appeared in court. The judge told them the child abuse homicide charge they face carries a maximum sentence of five years to life at the Utah State Prison.

Just hours after the hearing, community members hosted a gathering at a local church building for a candlelight vigil.

“It gives anyone and everyone a chance to say, ‘Gavin, we care and we’re sorry,’” Allred said. “It gives a chance to do that.”

Organizers collected more than 600 candles, along with 100 balloons and poster boards for those who attended. They encouraged anyone with a memory of Gavin to share it with others in the hope that the message would make it to the Utah Division of Child and Family Services.

“Why didn’t anything get done? I know multiple people called and I’m sure they’re heartbroken because nothing got done,” neighbor and vigil organizer Brindy Lipham said.

ABC4.com reached out to the Utah Division of Child and Family Services regarding Weber School District’s statement last week and did not hear back.

Charges are allegations only. All arrested persons are presumed innocent unless and until proven guilty beyond a reasonable doubt.
